Recent Drug Conspiracy Defense Victories

Although results obtained depend on the facts of each case, and each case is different, the following drug conspiracy cases are representative:

Charge: Conspiracy to the Violate Drug Laws
Police Report: The police executed a search warrant at a residence where the defendant is one of three individuals present. The police were able to locate drug contraband, including a scale, large amounts of cash and packaged cocaine.
RESULT: DISMISSED

Charges:
(1) Conspiracy to the Violate Drug Laws
(2) Possession with Intent to Distribute Cocaine
Police Report: Police walked into an apartment building and saw a woman attempting to hand the defendant money. The Defendant, upon seeing the police, quickly closes his hand and retreats back into an apartment. The police knock on the door and are let in by another individual. The defendant is handcuffed and the lady who was originally seen with the money tells the police she was trying to buy cocaine from the defendant. The police search the apartment and locate 12 substances of rock cocaine each piece individually wrapped.
RESULTS:
(1) DISMISSED
(2) DISMISSED

Charges:
(1) Conspiracy to Violate Drug Law
(2) Trafficking 14 grams or more of Cocaine
(3) Drug Violation in a School Zone
Police Report: Police executed a search warrant at a Fall River apartment. Upon entry into the apartment, the defendant (along with other individuals) is found to be in the residence. The defendant is located in the kitchen next to 61.5 grams of crack cocaine, a black digital scale, a box of sandwich bags, and 2.9 grams of marijuana.
RESULTS:
(1) DISMISSED
(2) Plea to 1 count of Simple Possession of Cocaine to be dismissed after successfully completing 1 year unsupervised probation (CWOF)
(3) DISMISSED

Charges:
(1) Unlawful Distribution of Heroin
(2) Possession with Intent to Distribute Heroin
(3) Conspiracy to Violate Drug Laws
(4) Assault and Battery
Police Report: Members of the Police Street Crimes unit executed a search warrant where the defendant and two other individuals were located. The defendant attempted to flee when the police were unable to gain entry through a barricaded door. The defendant is alleged to have escaped to the roof of the building where rocks were thrown at the chasing police. The defendant was apprehended and the police seized Heroin and large amounts of cash.
RESULTS:
(1) Plea to 1 amended count of simple possession of Heroin and sentenced to the time he had been held on bail (less then 4 months)
(2) NOLLE PROSSED
(3) NOLLE PROSSED
(4) NOLLE PROSSED

Charges:
(1) Possession with Intent to Distribute Marijuana
(2) Conspiracy to Violate the Drug Laws
Police Report: Police conduct a traffic stop in which the defendant is a passenger in the car. The driver provides false information to the police and is arrested for driving on a suspended license. The police locate 1 pound of marijuana in the car, which the driver says belongs to the defendant.
RESULTS:
(1) DISMISSED
(2) DISMISSED

Massachusetts Drug Conspiracy Laws

Chapter 94C: Section 40. Conspiracy

Whoever conspires with another person to violate any provision of this chapter shall be punished by imprisonment or fine, or both, which punishment shall not exceed the maximum punishment prescribed for the offense, the commission of which was the object of the conspiracy.
